After the Referendum passed with a landslide vote in favor of all five proposals, the first of which, was to oust the Board that had been in place, I wrote to the former board president, Joe Terrell, inviting him to work with us for all the positive changes our community, clearly and resoundingly, has demanded.

My hope was that Joe would graciously accept the results of the referendum and begin working with us, instead of trying to impede our efforts. Sadly, he wrote back making it clear he had no such intention. As we've heard the former Board and their small, handful of acolytes drone on and on about, he only made one more reference to the old "CCR rules," attempting to make it seem as if they carry the same weight as real laws, such as the ordinances of the City of Plano, or Texas state laws, when in fact, they do not!

Below is a copy of my response letter to Joe Terrell. In it, you'll see how I tried to help him understand the PUSHERSHIP that characterized the Board he was on and the many other Boards which preceded it are NOT going to be tolerated any more. Instead, the residents and non-resident owners of homes who have leased them out to the very good people who are an integral part of our neighborhood, will move forward to implement all the positive changes we want and need, with or without the support of the Old HOA pushership.

Your neighbor,

Rick

[The following is a copy of the letter I wrote to Joe Terrell, former President of Peachtree Village HOA, in response to his refusal to accept the results of March 29, 2025 Referendum.]

Joe,

I'm sorry to hear that you've not been paying attention to the people who live in our community, as well as those who don't but own homes they are leasing to many of our neighbors and, apparently, intend to ignore what they want.

With a resounding voice, the residents and nonresident owners have removed you and the other four, former Board members from office, as of last Saturday, March 29, 2025, in part because of having usurped positions on the Board by the so-called "legal process" which, in reality, has nothing to do with Local, State or Federal Law.

In fact, the secretive and manipulative way in which all prior elections of Boards of Directors at Peachtree Village HOA is anything but "legal." The use of "proxy" voting has done nothing but make it easy for a small group of people to ensure they, themselves, are placed in office without any kind of real plebiscite. This undemocratic practice will be done away with and, in its place, a REAL, DEMOCRATIC process of electing future Boards for Peachtree Village will replace it, that is, for as long as we have an HOA.

Anyone who would like to serve on any future Board will be required to make themselves known to everyone in our community, over a reasonable amount of time, put forward your plans and aims, and try to convince everyone you deserve to hold office. This is how democracy really works.

As to the ordinances of the City of Plano or any other real government body, we are well aware of how someone made false allegations of violations of City's ordinances regarding political signage and the height of lawn plants. And you should have been informed by the City of Plano no such violations took place. However, you should have also been informed that, according to Texas State Law, it is a Class C Misdemeanor to vandalize or steal a political sign.

Further, since we're talking about following the law, you should also be aware it is a crime to cut and cap a city water line, especially on the other side of a meter, as you spoke about doing, during your last Board meeting. I suggest you refrain from contemplating and engaging in any further of these truly illegal activities.

The fact that at least one Board member and others did all they could to suppress the votes in our recent Referendum belied the fact you know very well how vulnerable your claim to authority really is. You can invoke papers all day long, but there is really only one way to have true authority of any sort, one that has any chance of being respected, and that is by LEADERSHIP NOT PUSHERSHIP!

Instead of worrying about whether or not everyone in our community has read all the old, original CCR rules or all the changes prior Boards have made to them up until now, what you should have done is read our community minds and hearts.

So, rather than going on and on with political talking points (such as the old "you signed a paper" line), if you are refusing to cooperate with the mandate our community has issued, at least stand out of our way. We have a lot of REAL problems which the Board you were on and many before that failed to address. We, the Interim Board of Peachtree Village HOA are now going to work on those very real problems, with or without your support. But I highly recommend you contemplate the consequences of getting in our way, because our community is sick and tired of your obsession with decoration policing and the heavy-handed tactics you used to intimidate our neighbors into submission and extract money from them, and they are NOT going to put up with it anymore.

Your neighbor,

Rick
