Our Letters of Directives to Goodwin and Co.
Below are copies of the letters (2 so far) our new Peachtree Village HOA Interim Board sent to Goodwin and Co. by certified mail, the first of which was received on April 3, 2025, and the second sent to Goodwin & Co. on April 10, 2025
In sum, our 11 directives to Goodwin and Co. are of two types: those they must conform to immediately and others as soon as possible. Each directive specifies which of the two types they are.
Notice that, for now, we're not demanding the immediate termination of the service contract between Goodwin & Co. and Peachtree Village HOA (which was enacted under a previous Board of Directors in 2020). There are several reasons for this, but the primary one is because we are hoping, in a relatively short amount of time, to recover all of our funds that Goodwin & Co. is currently holding in at least two financial institution accounts which we have no direct access to. Were we to, right now, completely sever contract with Goodwin & Co., then they would no longer be legally obligated to serve at the direct behest of the Board of Directors and, therefore, could put up numerous obstacles and delay the transfer of our funds to an independent bank account which will be self-managed by the new Interim Board of Directors on behalf of all our residents and non-resident home owners. Also, there are numerous other sub-contracts and financial obligations that were made by Goodwin & Co. that, first, need to be terminated as soon as possible, such as the one with the landscaping company, the electric power supply company, the City of Plano water service, and so on. It would be a lot easier and faster for Goodwin & Co. to terminate those contracts than for our new Board to do so. Therefore, you'll see that we are directing them to tie up all these loose ends, and make final payments for all sub-contracted services already performed.
Of course, Goodwin & Co. may, very unwisely, attempt to disregard our directives, because they don't want to lose the management "service" fees and all the other fees they've been collecting up until now and which they had been hoping to greatly increase, having all but fully convinced the previous Board to increase our monthly dues (a measure we, the new Interim Board, firmly oppose). If so, there are several avenues of recourse we will have at our disposal to make them comply, but first, we are going to give them a reasonable amount of time to do the right thing:

Re: Directives From the New Interim Board of Directors, Peachtree Village HOA
To Ms. Aldridge and Whomever Else It May Concern at Goodwin and Co.:
On Saturday, March 29, 2025, a Referendum vote on 5 Proposals set before the residents and non-resident owners of homes in Peachtree Village (in East Plano, Texas) resulted in a resounding 95% to 5% approval of all 5 Proposals. The first Proposal was to, effective the same day, remove from office all 5 members of the Board of Directors—Joe Terrell, Barry Applewhite, Craig Williams, Brenda Herrick and “Mimi” Clotfelder. Following their removal, an Interim Board of Directors was selected by a vote of 75% to 25%.
Consequently, the new Interim Board of Directors of Peachtree Village HOA, with the overwhelming support of our community, as demonstrated in the open, fair and clearly stated plebiscite, which concluded last Saturday, March 29, 2025, and in accord with the established practice of the parties, to wit, the long-standing practice of former Peachtree Village HOA Boards, who, over the past years did, numerous times, made changes to the original CCRs, now asserts the full authority to act on behalf of all the residents and non-resident home owners of Peachtree Village. In this capacity and with said authority, the Interim Board of Directors for Peachtree Village HOA issues to Goodwin and Co. the following 10 (ten) directives:
1. Effective immediately, suspend all surveillance of our resident home properties.
2. Effective immediately, suspend all future, sub-contracted services, such as, the landscaping services provided hitherto by Southern Style Landscaping and the electrical power company which supplies power to the irrigation system pumps.
3. Effective immediately, pay off any and all financial obligations to any sub-contracted services for work already performed or services already provided, such as, the electrical power services to operate the irrigation system pumps.
4. Effectively immediately, cease and desist from posting any more articles aimed at discrediting the recent Referendum Proposals the residents and non-resident owners of Peachtree Village approved of in record numbers, either on the Town Sq portal and/or communications by email, text messaging, standard mail or any other means.
5. As soon as possible, close out the Money Market account which was funded by dues paid by Peachtree Village home owners, and deposit the funds into the Peachtree Village general account.
6. As soon as possible, close the water service account(s) with the City of Plano Utilities Department which, hitherto, provided water to our Peachtree Village greenbelt irrigation system.
7. Effective immediately, do not make any attempt to hire any plumbing sub-contractor to cut and cap the water service lines leading to any City of Plano meters. (This is illegal, and doing so could lead to criminal tampering charges.)
8. As soon as possible, notify the new Interim Board of Directors (you may use the contact information below) once you have all financial obligations paid, and money market funds transferred to the Peachtree Village HOA’s general account.
9. Unless Goodwin and Co. would rather terminate all services provided to Peachtree Village HOA, change the terms of our contract so Goodwin and Co. provides only accounting services, that is, to collect monthly dues only and deposit them into our general account, and only make payments at the direction of the Interim Board. In keeping with this new role for Goodwin and Co., modify the monthly management fee accordingly.
10. As soon as possible, issue full refunds to each and every Peachtree Village homeowner who was issued a “fine” by Goodwin and Co., going all the way back to when Goodwin and Co. was first contracted to serve as HOA property manager for Peachtree Village HOA, for any “violation,” who then subsequently paid said fines. These refunds shall include any and all other fees, such as those collected on the basis of “fee stacking,” charges for letters issued, late fees for not paying said charges, and so on.
11. As soon as possible, supply either the originals or accurate copies of all documents in the possession of or accessible by Goodwin and Co. pertaining to Peachtree Village HOA, including, but not limited to, a) all documentation of past Board of Director elections (records of attendees, ballots, both direct and proxies), b) all financial records, such as the account numbers of sub-contracted accounts (like with the City of Plano Utilities dept for water service and with the electric power service provider), c) all contact information of Peachtree Village home owners, both resident and non-resident, such as email addresses, phone numbers, PO boxes or other addresses where mail is received, and social media contacts, d) all certified resolutions of the Board of Directors of Peachtree Village Homeowner’s Association that were submitted and registered with the Official Public Records of Collin County, e) motions passed by all Peachtree Village HOA boards up until March 29, 2025, f) all letters, without redaction, sent to homeowners regarding alleged “violations,” and “fines” assessed and/or collected, g) the latest financial balance of Peachtree Village HOA, including the money market fund, and a list of any outstanding financial obligations yet to be paid, h) our US federal IRS EIN number, and i) any and all other pertinent documents not hitherto specified.

Re: More Directives From the New Interim Board of Directors, Peachtree Village HOA
To Ms. Aldridge and Whomever Else It May Concern at Goodwin and Co.:
We were very disappointed to discover Goodwin & Co. chose to disregard our directive Number 4, issued in our letter of April 2, 2025, which read:
Effectively immediately, cease and desist from posting any more articles aimed at discrediting the recent Referendum Proposals the residents and non-resident owners of Peachtree Village approved of in record numbers, either on the Town Sq portal and/or communications by email, text messaging, standard mail or any other means
By posting and distributing a letter by the former HOA Board which, among the several distortions and lies it contained, dismissed the legitimacy of our recent Referendum, in which, all previous Board members were removed from office, on March 29, 2025.
For this reason, we, the Interim Peachtree Village HOA Board now directs Goodwin & Co. to, expeditiously, comply with 10 of the 11 of directives previously issued to you in our letter of April 2, 2025, with the exception of Directive 9, which is now amended to read as follows:
o Upon completion of all necessary actions in order to pay for all obligations to sub-contractors or for any other services ALREADY RENDERED, Goodwin & Co. is now directed to contact the new Interim Peachtree Village HOA (contact information is listed below) for instructions on which account of a financial institution to transfer the entire balance of the money paid by our members into the account(s) Goodwin & Co. has, heretofore, been managing, as the last obligation of Goodwin & Co. to Peachtree Village HOA as we move toward complete self-management.
o Further, Goodwin & Co. is directed to no longer accept any more HOA dues payments, and to reimburse any payor (payer) for any and all payments made to Peachtree Village HOA as soon as possible from the date of receiving this letter of new directives.
o Finally, Goodwin & Co. is directed to cease and desist from all participation in any further activities or “services” regarding an “election of a Board of Directors” or an “annual meeting.” This includes, but is not limited to, making any more communications on the Town Sq portal, emails, US mail, text messages, or phone calls, with respect to any “annual meeting” or “election of a Board of Directors.”

Letter Three

Re: Vandalism, Trespassing, and Expedited Document Handover
To Ms. Aldridge and Whomever Else It May Concern at Goodwin and Co.:
Yesterday morning, one or more persons trespassed onto the private property of one of our resident homeowners and destroyed all the native plants that had been growing in a test zone, as part of our project to determine the best way to convert our terra properties to environmentally- and economically-sustainable native plants. This experiment was being conducted in cooperation with the City of Plano’s Environmental Sustainability and Neighborhood Services departments. Upon witnessing the damage caused by the trespasser(s)/vandal(s), a report, by sworn affidavit, to the Plano Police Department was made who have designated this act as a Criminal Mischief offence, a Class C Misdemeanor.
We are quite sure this crime was committed at the behest of Joe Tarell, the former “President” of the Peachtree Village HOA, either by “Mr. Curtis,” or one or more employees of his company--Southern Style Landscaping, the same company we had already directed Goodwin & Co., in our previous certified letters, to terminate contract with. But since your company has not complied with our directive, now Goodwin & Co. is involved, to some degree, in the commission of this criminal offense!
Therefore, we, the Interim Board of Directors of Peachtree Village HOA urge you to end the contract with Southern Style Landscaping with all urgency. Also, we expect Goodwin & Co. to cooperate fully with the investigation of this crime by the Plano Police Department, by providing any documentation or information about who committed this offence that you may have or have access to.
Also, we are wondering why it’s taking Goodwin & Co. so long to comply with all our other directives. We hope our patience is not being taken for granted! We urge you to employ all due diligence to comply with all the 11 directives we’ve given you, as soon as possible.
That said, there is one directive which needs to be expedited above all others—the turnover of the documents related to last year’s June 6, 2025 Peachtree Village “Annual Meeting.” Specifically, we direct you to convey, as expeditiously as possible, the unaltered, original and complete homeowner sign in sheet designating who attended that meeting in person, as well as the approved minutes of the same. Please forward these documents to Peachtree Village HOA, P.O Box 860143, Plano, TX 75086-0143.e
Finally, we direct you once more to cease and desist from any further attempts to assist the former “Board” in their efforts to impede the progress of our HOA as we move to self-management and in a new direction of positive, respectful and cooperative practices, which has already resulted in tangible improvements to the appearance of our neighborhood, a general sense of relief as the abuses committed by Goodwin & Co. (on behalf of what is now quite clear an illegitimate Board of Directors) are now a thing of the past, and a sense of pride in our homes and community is now being restored, thanks to the reacquisition of home sovereignty.
